Independent Class Immigration (Skilled Worker)

Selection Criteria

Canada has a set of criteria against which potential immigrants are assessed. The main criteria are related to your occupation ? that is, the type of work you intend to do in Canada and the skills, qualifications and experience you have in that occupation. In order to immigrate to Canada as a skilled worker, you must have at least 70 points in the assessment system. Points are based on:

  1. Age (maximum 10 points) : Points are given for one's age at the time his application is received.
  2. Education (maximum 16 points): Better have a college diploma or university degree.
  3. Occupation (maximum 10 points) : One must get at least one point in this factor to be considered.
  4. Education/Training Factor (maximum18 points): ETF refers to the length of training, education, and/or apprenticeship required to work in the applicant's occupation in Canada.
  5. Arranged Employment (maximum 10 points): One can get 10 points if he has a job offer already in Canada.
  6. Work Experience (maximum 8 points): One must have the equivalent of at least one year's experience in the occupation to score a point in this factor.
  7. Language Ability (maximum15 points): One can get 15 points if fluent in both of Canada's official languages(English and French).
  8. Demographic Factor (10 points): This is a number set by the federal government. The usual score is 8.
  9. Personal Suitability (maximum 10 points): This factor has to do with how well a person and his/her family are deemed able to settle successfully in Canada. It is usually determined in the interview.

Business Class Immigration

Classes of Immigration

Applications for immigration to Canada are processed in different classes. Family Class immigrants are sponsored by close relatives in Canada. Refugees are accepted on humanitarian grounds. Independent Class applicants are assessed on factors related to finding employment and adapting to life in Canada. Business Immigrants are Independent Class applicants who receive priority because they do not require employment and will create jobs for others through their business investments. Typically they are talented, ambitious people who are also welcomed by other countries and throughout Canada. Business Immigrants may be either Entrepreneurs or Investors.

Are You an Entrepreneur?
If you can answer YES to each of the following questions, you may qualify for immigration as an Entrepreneur:

  1. Have you owned, operated or controlled a successful business?
  2. Do you have the ability and intention to establish, purchase or invest in a new or existing business in Canada?
  3. Will your investment result in new or continued employment of one or more Canadian residents other than you or your dependents?
  4. Do you have the ability, experience and intention to provide day to day management of the business?
Are You an lnvestor?
If you can answer YES to each of the following questions, you may qualify for immigration as an Investor:
  1. Do you have a net worth (assets minus liabilities) of at least $800,000? Was it accumulated through your own business endeavours?
  2. Have you successfully operated, directed or controlled a business?
  3. Are you prepared to invest at least $500,000 for a minimum of five years, in an approved business or fund?

  4. Your application package is submitted by our lawyer and the notice of initial assessment result is issued.

  6. Undergo medical examination and receive your visa if everything is OK.
Note :
  1. As an Entrepreneur you will receive a visa with "terms and conditions." These terms and conditions require you to start your business activity within two years of landing in Canada. Investors receive unconditional visas because they make eligible investments before their visas are issued.
  2. Your visa will be valid for twelve months from your medical examination. You and all dependents named on the visa must take up permanent residence in Canada before the visa expires. A visa cannot be extended.
  3. The process can take from six to more than twelve months from the date you submit your application until you receive your visa. Use this time to increase your knowledge of business and business opportunities in British Columbia and your English language skills.
Business Class Application Q & A
1. Should I apply as an Investor or as an Entrepreneur?
If you have a net worth of at least $800,000, you may qualify for immigration in either class. If you do not intend to be actively involved in the management of your own business, apply as an Investor. If you plan to become actively involved in the management of your own business or a partnership, apply as an Entrepreneur.

2. Should I apply as an Investor just to get an unconditional visa?
A visa with terms and conditions is not an obstacle for an Entrepreneur. Visit the province, attend the immigration and "Investment seminar" in Vancouver and undertake some basic market research. You should have no difficulty in developing a good business opportunity that will also satisfy the terms and conditions of your visa within two years of your arrival in British Columbia. If you want to be an Entrepreneur but you apply as an Investor, your capital in your immigration qualifying investment will not be available to you or your new business for at least five years.

3. Do I need a business plan?
The Business Immigration Branch does not require a business plan from business immigration applicants. However, if you are an Entrepreneur, the immigration officer who interviews you will assess your ability to establish yourself successfully in business in Canada. To assess your knowledge and understanding of the business conditions in British Columbia, the officer may ask you to submit additional information. The 揑mmigration and Investment? seminar in Vancouver will help you greatly in understanding the economic structure, the business environment and the lifestyle in British Columbia. Our lawyer will also provide legal advice to help you with your documents.

4. As an investor, how do 1 invest in an approved business or fund?
If you apply as an Investor, your immigration-related investment must be in an approved business or fund. An approved business or fund is one which has been accepted by Canada and British Columbia for immigration purposes. Our lawyer will help you pick up the most suitable to invest.

5. As an Investor, can 1 live in British Columbia when my immigration-qualifying investment is in another province?
Yes, you can. However, you should consider carefully the advantages of making your investment in British Columbia. The ten provinces and two territories of Canada are different in size, extent of industrial development and rate of economic growth. These differences affect your ability to profit from your investment or to recover your capital. It is difficult to monitor your investment when it is thousands of kilometers away.

6. Can I invest in my friend's business?
An Entrepreneur may invest in any business that meets the British Columbia guidelines for acceptable business investments and in which the Entrepreneur will take an active management role. An Investor may invest in any business that Canada and British Columbia consider eligible. If you wish to invest in a business that is not on the approved investment list, our lawyer will contact the Business Immigration Branch for guidance on how to qualify.

7. Can I invest in my own project?
Entrepreneurs can invest in their own project or a partnership provided they are actively engaged in the management of the business. Investors cannot make an immigration-qualifying investment in their own business.

8. Do 1 have to own property in British Columbia before I can receive an immigrant visa?
No. While you may own land or buildings in Canada, it will not affect whether you get a visa or how long it takes to get a visa. Business immigrants are selected for their business background and suitability.

9. Why Does British Columbia Seek Business Immigrants?
Business Immigrants have a direct positive effect on British Columbia's economic growth and prosperity. In 1993, for example, the 1,357 Entrepreneurs and 1992 Investors who received visas for British Columbia declared total assets of $6.5 billion and are projected to secure over 10,000 jobs. In addition to providing capital for industrial development, they brought expertise in international trade, tourism, and advanced technologies, and expanded recreational and educational facilities in their new communities.

10. Can 1 satisfy my visa terms and conditions through a partnership in a new or existing business?
Yes, you can. You may enter a partnership with anyone. The partnership may involve an existing business or may create a new business. The job creation and investment requirements described above apply to each Entrepreneur in the partnership wishing to have visa terms and conditions removed.

11. The advantage of doing business in British Columbia ?
There are excellent business opportunities throughout British Columbia whether you are considering starting a new business or investing in an existing one. Locating your business outside the major metropolitan areas means lower land and operating costs and a large pool of available labour. Excellent education and other community facilities are accessible in all areas of the province. Local authorities are interested and involved in helping new businesses establish successfully. The family orientation and natural friendliness of smaller communities can be substantial advantages.
British Columbia is a centre for international business. Our exporters enjoy excellent trading relations around the world. Sophisticated transportation networks and facilities move products to market by sea, air, road and rail. Favourable International Maritime Centre and International Financial Centre tax legislation encourages location of international shipping and banking businesses in British Columbia.
The North American Free Trade Agreement is greatly expanding opportunities for British Columbians.

Family Class

Canadian citizens and permanent residents, aged 19 and over , and are living in Canada, have the right to sponsor the applications of certain close relatives who wish to immigrate to Canada. All persons being sponsored, together with their dependants, must meet the requirements of the Immigration Act and Regulations.

Relatives eligible for sponsorship in the family class include the sponsor's:

  1. wife/husband
  2. fiance(e)
  3. dependent son or dependent daughter (see below)
  4. parents, grandparents
  5. brothers, sisters, nephews, nieces, grandchildren, who are orphans, unmarried and under 19
  6. children under 19 the sponsor plans to adopt
  7. any other relative, if the sponsor does not have any of the above or any family in Canada.

Dependent son or dependent daughter
There are three ways sons or daughters can be "dependent" on their parents:

  1. Under age 19 and unmarried

must be unmarried when they apply for a visa and still unmarried when the visa is issued

  2. Full time students

must be studying at a college, university, or other educational institution

must be studying or training when they apply for their visa and when the visa is issued

must have been supported financially by their parents from age 19 or from the date of their marriage

  3. Children with a disability

must be supported mainly by their parents

be unable to support themselves because of the disability

Unlike the class of independent and other immigrants, family class applicants are not assessed under the point system, but they must meet the basic standards of good health and character. As well, before an immigrant visa can be issued to applicants in the family class, the sponsoring relative in Canada is required to sign an undertaking of support. In this statement, the sponsor promises to provide for the housing, care and maintenance of the applicant and accompanying dependants up to ten years.

Refugees

Groups of at least five Canadian citizens or permanent residents 19 years of age or older, or local organizations which are legally incorporated may sponsor Convention refugees, members of a designated class and their families . Undertaking a sponsorship agreement means agreeing to provide settlement assistance for the refugee(s) for a period of one year. Both sponsors and refugees must meet the requirements of the Immigration Act and Regulations. The definition of a refugee in the Act is based on the definition in the United Nations Convention and Protocol Relating to the Status of Refugees.

Note: Please contact us(Email: info@mapleroad.net Fax: 1-604-941-8128 ) for a free assessment if you do not meet the criteria of independent and business immigration category.
